 Divorce FAQs

  • To file for divorce in the state of Oklahoma, you must be a resident of the state of Oklahoma for more than six months and a resident of your county for more than thirty days.

  • The cost of a divorce can vary depending on the factors and circumstances.  A consultation would provide more clarity on an estimated cost.

  • Once a petition is filed, a judge can grant a divorce within ninety days but this varies depending on the complexity of the case and whether children are involved.

  • Title 43 O.S. Section 110 authorizes a judge to enter orders at the beginning of a contested divorce which decides certain pressing issues until the entire case can be heard at trial. The temporary orders usually consist of possession of the property, custody of children, and any support needed.   The temporary orders can be changed at any time during the case.   A hearing for temporary orders is held shortly after the petition for divorce is filed.

    • Child Support / Typically the non-custodial parent will have to pay child support which is computed by using the statutory chart  43 O.S. § 119

    • Alimony / Generally an award of alimony is based on the spouse's need for support and the spouse’s ability to pay support. There must be a demonstrated need for support from one spouse to the other. The judge takes several things into account, including but not limited to the lifestyle, earning capacity, physical condition, duration of the marriage, and prospective employment. 

    • Property / Each spouse’s property received before marriage or gift/inheritance is awarded to the spouse that came into the marriage with it. The marital property is justly and equitably divided based on circumstances. This is not always a 50/50 split. Debts are included and typically follow the collateral in which it is attached or can be separated.

  • Only a judge in court can determine if a Common Law marriage actually existed.  This can be proven through actions by the “spouses” that are consistent with marriage, telling others that they are married, living together, or the community recognizing the marriage as valid.

  • Yes, a specific child custody class is required.
